Limited Warranty: U.S. & Canada
Oki Data Americas, Inc. (Oki Data) warrants this Consumable item
(hereinafter Consumable) to be free from defects in material and
workmanship under normal and proper use, provided however, that it is
properly stored and maintained in the original packaging. This
Limited
Warranty
is subject to the conditions set forth herein and shall remain
in effect for a period of ninety (90) days from the date of purchase by
the end user.
Should a Consumable which has been properly stored and maintained
in the original packaging be determined by Oki Data to be defective, it
will be repaired or replaced, at Oki Data’s option, at no charge to the
end user. This is customer’s exclusive remedy under this
Limited
Warranty
.
This
Limited Warranty
shall not apply to normal wear and tear and shall
not apply if the consumable has been damaged due to abuse, misuse,
misapplication, accident, improper storage, or installation, an
unsuitable physical or operating environment, or as a result of service
or modification by any other than an authorized Oki Data service
center.
To make claim under this
Limited Warranty
, the original purchaser must
return this Consumable to the place of original purchase or to Oki Data.
Consumables returned to Oki Data are to be returned in the original
package or equivalent, shipper to bear cost of shipping and risk of loss
in transit and must be accompanied by a written receipt for the
product, showing the date of purchase, dealer’s name and item
purchased. This
Limited Warranty
is not transferable.
THERE ARE NO EXPRESS WARRANTIES OTHER THAN THOSE ON
THE FACE HEREOF AND DESCRIBED ABOVE.
NO WARRANTIES
WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT
LIMITED TO, ANY IMPLIED WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE,
SHALL EXTEND BEYOND THE RESPECTIVE WARRANTY PERIOD
DESCRIBED ABOVE OF NINETY (90) DAYS.
Some states do not allow limitations on how long an implied warranty
lasts, so the above limitation may not apply to you.
IN NO EVENT SHALL OKI DATA OR ITS AFFILIATES BE LIABLE
TO A PURCHASER OR ANY OTHER PERSON FOR SPECIAL,
COLLATERAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL
DAMAGES INCLUDING LOST PROFITS, BUSINESS REVENUE,
GOODWILL OR ANTICIPATED SAVINGS) IN CONNECTION WITH
OR ARISING OUT OF THE PURCHASE OR USE OF THE OKI DATA
CONSUMABLE, WHETHER ARISING IN CONTRACT OR IN TORT,
WHETHER OR NOT CUSTOMER SHALL HAVE INFORMED OKI
DATA OF THE POSSIBILITY OR LIKELIHOOD OF ANY SUCH
DAMAGES.
Some states do not allow the exclusion or limitation of incidental or
consequential damages, so the above exclusion may not apply to you.
THE SOLE AND EXCLUSIVE LIABILITY OF OKI DATA AND ITS
AFFILIATES, AND THE SOLE AND EXCLUSIVE REMEDY OF SUCH
PURCHASER AND ANY OTHER PERSON, SHALL BE THIS LIMITED
WARRANTY.
IN NO EVENT SHALL THE LIABILITY OF OKI DATA
AND ITS AFFILIATES, REGARDLESS OF THE FORM OF ACTION,
EXCEED THE PURCHASE PRICE OF THE OKI DATA CONSUMABLE.
ADDITIONAL WARRANTY DISCLAIMERS FOR ALL PURCHASERS
EXCEPT CONSUMERS:
WHEN ANY OKI DATA CONSUMABLE SHALL BE PURCHASED BY
ANY PERSON SUCH THAT THE OKI DATA CONSUMABLE IS NOT
A "CONSUMER GOOD" (AS DEFINED IN THE UNIFORM
COMMERCIAL CODE ADOPTED IN THE STATE OF PURCHASE OR
IN OTHER APPLICABLE LAW), OKI DATA EXPRESSLY
DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WITHOUT
LIMITATION THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE.
