3.7 Transfer. You may not transfer any of your rights under this EULA to any third party. 3.8 Termination. Without prejudice to any other rights SONY may have, your rights under this EULA will terminate automatically if you fail to comply with the terms and conditions of this EULA. In such event, you must return the Software to SONY or submit to SONY proof of the destruction of all copies of the Software and all component parts thereof. Articles 5 through 10 of this EULA shall survive such termination. 4. RIGHT All title to and copyrights on the Software (including but not limited to audio, music and text incorporated into the Software) are owned and/or controlled by SONY and/or the applicable content owner(s). All rights not specifically granted under this EULA are reserved by SONY or such content owner(s). 5. LIMITED WARRANTY ON MEMORY STICKTM SONY warrants that, for a period of ninety (90) days from the date of your actual receipt of the Memory StickTM on which the Software is stored, the Memory StickTM as a recording medium will be free from defects in material and workmanship under normal use. This limited warranty extends only to you as the original licensee. SONY's entire liability and your exclusive remedy will be replacement of the Memory StickTM not meeting SONY's limited warranty and which is returned to SONY with proof of the original purchase in the form of a bill of sale (which is evidence that the Memory StickTM is within the warrant period). SONY will have no responsibility to replace the 28 Memory StickTM if damaged by accident, abuse, misuse, misapplication,
