IBM’s

liability

for

any

damages

and

losses

that

may

arise

as

a

fulfillment

its

obligations

under

Statement

Limited

Warranty

to

compensation

only

those

damages

losses

proved

actually

arising

as

an

immediate

direct

IBM

amount

equal

to

the

charges

paid

for

Machine

that

has

caused

the

damages.

“Machine”

Machine

Code

Licensed

Internal

Code

(“LIC”).

limitation

shall

not

apply

to

damages

for

bodily

injuries

(including

death)

and

damages

to

real

property

and

tangible

IBM

is

legally

liable.

case

IBM

or

your

reseller

is

unable

to

repair

an

IBM

reduction

for

cancellation

respective

agreement

such
