15 Warranty and Software License Hardware Product Limited Warranty HP warrants this hardware product against defects in materials and workmanship, under normal use, for the period specified in the NetServer Limited Warranty Table section below. The warranty period begins on the date of delivery or on the date of installation if installed by HP or an Authorized HP Reseller (hereafter referred to as "Reseller.") If Customer schedules or delays HP/Reseller installation more than 30 days after delivery, warranty begins on the 31st day from delivery. HP products may contain remanufactured parts equivalent to new in performance, or may have been subject to incidental use. If HP or Reseller receives notice of such defects during the warranty period, HP or Reseller will either, at its option, repair or replace products that prove to be defective. Repair or replacement will be performed by HP or Reseller, at its option, at Customer's premises or "On-site," by the Return-to-HP/Reseller process, or by use of the Customer Replacement Part process. Replacement parts assume the remaining warranty of the parts they replace. Replacement parts are new or equivalent to new. When service involves the exchange of an NetServer or a part, all removed parts, in their entirety, become the property of HP and must be returned to HP. The replacement part becomes Customer's property. HP or Reseller will restore the warranted hardware product to factory original hardware functionality. Customer is responsible for restoring any Network Operating System, applications, or data. Should HP or Reseller be unable to repair or replace the product within a reasonable amount of time, Customer's alternate remedy shall be a refund of the purchase price upon return of the hardware product. 109
