Table of Contents Index 245 Additional Information...Skype End User License 5.2.1.1.14 Article 21 GENERAL PROVISIONS 21.1 Creation of the Skype Group Account. To make use of the Skype Group Service, a Skype Group Administrator shall register for a Skype Group Account with Skype, appoint Skype Group members and more Skype Group Administrators (optional). All Skype Group Administrators shall have the same rights to manage the Skype Group Account, and they shall be jointly and severally responsible for the administration and control of the Skype Group Account and Skype Group members as long as they belong to the Skype Group. For the avoidance of doubt, even as a member of a Skype Group, You shall be directly responsible for Your compliance with this Agreement and the End User License Agreement, and liable for any breach thereof, in accordance with such agreements. 21.2 Tariffs and Payment; Allocation of credit. For credits for the Skype Group Service purchased, Skype Group Administrator shall pay Skype the tariffs in accordance with Article 7. The Skype Group Administrator shall allocate the credits of the Skype Group Account to the members of Skype Group for the VoIP service as agreed upon with these members. 21.3 Refund. Skype Group Administrator is entitled to request a refund for the unused credits that have not been allocated to individual Accounts of Skype Group members or have been re-allocated to Skype Group Administrator by such members. For the avoidance of doubt, Skype Group members have no obligation to return any credit already allocated to them. 21.4 Terms of Service. . Members of a Skype Group are not allowed to belong to more than one Skype Group at the same time. The Skype Group Administrator guarantees that it will inform the members of the Skype Group of the applicability of these Terms of Service and acknowledges that it shall be responsible of their acceptance thereof. 21.5 Indemnification. The Skype Group Administrator agrees to indemnify and hold Skype and (as applicable), Skype Staff, Affiliates harmless against any and all third party claims, including but not limited to claims of members of the Skype Group, actions, proceeding and costs, including but not limited to reasonable attorney's fees, incurred by Skype, arising out of or relating to the Skype Group Service provided to the Skype Group Administrator or the use or protection of personal and/or traffic data of Skype Group members by the Skype Group Administrator. 5.2.1.1.15 Article 22 PERSONAL AND TRAFFIC DATA 22.1 Personal and Traffic data. Upon designation of members into a Skype Group, the Skype Group Administrator shall be responsible to inform each member that each Skype Group Administrator may in the course of Skype Group Service provision obtain information concerning their personal and traffic data. The Skype Group Administrator represents and warrants to keep all such personal and traffic data confidential and use and protect it strictly in compliance with applicable data protection act(s).
